This issue was addressed by a Federal Court deciding a Social Security disability case a few years ago. The Court stated the VA rating is to be given “substantial weight” in deciding entitlement to Social Security disability. After all, the purpose of the Social Security and VA disability programs are closely related so that “a disability rating by one of the two agencies is highly relevant to disability determinations of the other agency.”

Therefore, if you have a 100% VA disability rating, it is likely you should be found disabled by Social Security as well. If you have been denied Social Security benefits, let us help you appeal.
